The Court has adjourned hearing of the criminal trial of Assin North Member of Parliament-elect James Gyakye Quayson to July 4.
This is to allow for his lawyers to move motion for stay of proceedings pending appeal at Court of Appeal TV3’s Laud Adu Asare reported on Thursday.
Mr Gyakye Quayson is appealling a High Court ruling to have his criminal case heard on a daily basis.
The Court presided over by Justice Mary Yanzuh on Friday, June 23 dismissed an application by lawyers of Mr Gyakye Quayson to have hearing on the case varied.
The ruling implied the MP would from Tuesday, July 4, when hearing begins, appear in court daily irrespective of his status as a lawmaker.
He also cites the ruling as a breach of Mr Gyakye Quayson’s right to fair trial.
His lawyer Mr Tsatsu Tsikata had argued in court last Friday that his client was on a national assignment as regards his contest in the Assin North by-election, citing Article 55(13) of the 1992 Constitution to have his application granted.
He also accused the Attorney General of making prejudicial comments on the matter in media interviews.
But Justice Mary Yanzuh told the court that adjournments are solely done at the discretion of the court and not the convenience .
