The High Court (Human Rights Division) has granted an interim injunction, restraining the Office of the Special Prosecutor (OSP) from arresting former presidential staffer and Secretary of the defunct Inter-Ministerial Committee on Illegal Mining(IMCIM), Mr. Charles Bissue.
The order of the court follows an application filed by lawyers of Mr Bissue, and will last 10 days.
The interim injunction also restrains the OSP from publishing notices declaring Mr. Bissue as a wanted person and also applying for a further warrant of arrest.
Background
On Tuesday, the OSP issued a notice declaring Mr. Bissue wanted following his failure to respond to an invitation for interrogation over alleged corruption and corruption-related activities relating to the dissolved IMCIM. The notice came days after the OSP secured a court warrant for the arrest of Mr. Bissue.
Mr. Bissue recently filed a second suit at the High Court seeking to stop the OSP from investigating him.
He contends that the OSP does not have the power to investigate such a matter that has already been investigated by the police.
And is thus seeking a declaration that the OSP’s investigation into the same matter as has been investigated by the police and its subsequent prosecution would amount to a review of the police investigations and findings.
Hearing of the substantive case continues on June 22, 2023.
